ACTUAL ISSUES OF IMPROVING THE LEGISLATIVE SYSTEM, REGULATING DEVELOPMENT OF AGRICULTURAL CONSUMER COOPERATION

Abstract

Agricultural consumer cooperation is one of the main institutions of the agro-industrial complex development. Its role in solving the problem of ensuring food security at the present stage of development increases in connection with the introduction of sanctions against Russia. The article contains an analysis of the state and trends in the development of legislation regulating the activities of agricultural cooperatives of the consumer type. It is concluded that the reasons for their unsatisfactory development are largely due to the lack of effective legal support that takes into account the specific character of the cooperative form. Separate provisions of legislative acts contradict not only each other, but also the Civil Code of the Russian Federation. Today, there is no clear legal definition of the cooperative form. There is a tendency of development of cooperative legislation in the direction of equalization of agricultural cooperatives with commercial forms of management functioning in the agrarian economy. A number of recent legislative innovations jeopardize the very existence of the cooperative movement in the agrarian sector of the economy. As criteria for assessing the current cooperative legislation, it is justified that its provisions comply with the principles and values of co-operation, as well as with the established practice of cooperative relations. The proposed measures to improve co-operative legislation are based on the need for the most complete reflection of cooperative identity in it.
